Hearsay Evidence

Home |

Verbal Acts
Audrey sues Bill for a $100 debt. Craig testifies that he, Craig, was present when Bill paid Audrey the $100. He testifies "I saw Bill pay Audrey $100. Bill said that he was repaying his debt to her." Audrey objects to Craig’s testifying about what Bill said as hearsay. How do you rule?
  1. Sustained. Craig is testifying about Bill’s out-of-court statement which is hearsay.
  2. Overruled. Craig’s testimony about Bill’s statement is admissible because it is not hearsay.
