Exception - Medical Reports
Allen offers medical records of his doctor as evidence to support his claim that the light was red for Bob. Allen’s doctor wrote in her chart of Allen's medical history that "Allen complains that he is suffering from back pain he derived when Bob ran a red light and struck his car." Is the medical record admissible?
  1. No. The medical record is Allen's out-of-court statement to the doctor and is inadmissible hearsay.
  2. Yes. Medical records are admissible as exceptions to the hearsay rule.
