Exercise: The Accident
C. Overruled. Bob was present when Carl made the statement so it is admissible.

Incorrect. Allen is testifying as to an out-of-court statement made by Carl offered to prove the truth of what it asserts, namely that the light was changing. It is inadmissible hearsay. Whether or not Bob heard the statement at the time Carl made it has no bearing on its admissibility at trial.
