NM Court System Structure

Home

Each of New Mexico's 33 counties has a Probate Court, with one judge sitting in each court.

These courts only hear cases that relate to informal probate of estates, but only in uncontested cases. Contested cases go to District Court.

There are no jury trials in Probate Court.

Probate Judges are elected every four years and may only serve two terms of office. These judges are generally not required to be attorneys.
