1.5-3 Forcible Entry or Unlawful Detainer

A. Procedure; Complaint

  1. The forcible entry and unlawful detainer statutes, Sections 35 10 1 through 6, do not apply to actions by a landlord arising out of a residential tenancy governed by the Uniform Owner Resident Relations Act. Section 35-10-2; see also §1.6-1 of this Benchbook regarding the Uniform Owner Resident Relations Act. Forcible entry and detainer actions primarily cover residential property excluded from the Uniform Owner Resident Relations Act, such as oral leases in residential tenancies, as well as commercial and business property.
  2. Except for the special considerations discussed below, actions in forcible entry and detainer are treated like other civil actions.
  3. An action for forcible entry or unlawful detainer is initiated by the plaintiff filing a civil complaint, as in other civil actions. Civil Form 4-203 (Complaint in Forcible Entry or Unlawful Detainer). The civil complaint must allege that one or more of the following facts exist:

    a. The defendant entered and occupied the lands and tenements of another against the will or consent of the owner and refused to vacate the premises after notice by the owner or the owner's agent or attorney. Section 35-10-1(A).

    b. The defendant holds over after the termination, or contrary to the terms of, the lease or tenancy.

    c. The defendant fails to pay rent at the time stipulated for payment.

    d. The defendant continues in possession after a sale by foreclosure of mortgage or on execution unless the defendant claims by a title paramount to the mortgage under which the sale was made or by title derived from the purchaser at the sale. Or,

    e. The defendant is a tenant at will and continues in possession of the premises after 30 days' written notice to vacate by the owner or the owner's agent.

  4. The district court in the county in which the real property is located has concurrent original jurisdiction in civil actions for forcible entry or detainer when the contracted rent or reasonable rental value of the property is $50 or more per month. Section 35 10 1(B).
  5. Written notice to vacate the premises occupied or detained by the defendant must be given to the defendant not less than 3 days before the complaint is filed. Section 35 10 3(A). If the defendant is a month to month tenant or a tenant at will, and if the tenant continues in possession of the premises, written notice to vacate must be given the tenant by the owner or the owner's agent not less than 30 days prior to the filing of the complaint. Section 35-10-1(A)(5).
  6. The return date in the summons must be no less than three and no more than ten days from the date of service. Section 35-10-3(B). In practice, the trial is often held on the return date; in this situation, the summons form must be modified to state clearly that trial will be held (not merely an answer filed or appearance made) on the return date.

B. Judgment (Section 35-10-4(A); Civil Form 4-701 (Judgment))

  1. A judgment against the defendant in a forcible entry or detainer action is for:

    a. damages, costs, and interest, if applicable; and

    b. removal of the defendant from the premises and return of possession to the plaintiff.

  2. The court approved judgment form is used; the provision for judgment for forcible entry or detainer at the bottom of the form is checked and completed by the judge.

C. Execution

  1. An execution in forcible entry or detainer is used when a judgment is entered against a defendant in an action for forcible entry or requires taking possession of the premises. Section 35-10-6; Civil Forms 4-801 (Writ of Execution) and 4-802 (Writ of Execution in Forcible Entry or Detainer).
  2. The total amount of the judgment is entered on the form for execution in forcible entry or detainer.
  3. An execution in forcible entry or detainer orders the sheriff to:

    a. cause the defendant to be removed from the premises;

    b. turn over possession to the plaintiff;

    c. levy the amount of judgment, together with the sheriff's fees and other costs since entry of judgment, against the defendant's personal property not exempt by law and located within the court of limited jurisdiction's district.

  4. No execution shall issue from the court of limited jurisdiction against the real property of the defendant. Section 39 4 2.
  5. The original and a copy of the execution are delivered to the sheriff by the plaintiff or plaintiff's attorney, and a copy is retained by the court.
  6. A copy of the execution is served on the defendant wherever the defendant may be found in the state. Magis. Ct. R. 2-801(B); Metro. Ct. R. 3-801(B).
  7. Upon receipt of the execution, the sheriff calls on the defendant and orders removal from the premises. If the defendant refuses to give up possession, the sheriff makes a return to that effect.
  8. The sheriff also levies on the property of the defendant for payment of the judgment and additional costs. The levy and sheriff's sale are conducted as for a writ of execution. See §1.4 1(F) of this Benchbook regarding levy and sheriff's sale.
  9. The return form on the original writ of execution is completed and returned to the court; a return must be made by the sheriff on every execution in forcible entry or detainer.

    a. The original writ and return form are filed with the court.

    b. The return states the facts pertinent to return of the execution.

    c. Return must be made within sixty days from the date the court issued the execution. Magis. Ct. R. 2 801(I); Metro. Ct. R. 3-801(I).

D. Appeal (Section 35 10 5(A))

  1. A defendant who appeals but is not successful in district court is assessed damages by the district court for the actual value of the rent due until the entry of judgment and for double the value of the rent from the date of entry of judgment in the court of limited jurisdiction to entry of judgment in district court.
  2. If the defendant appeals the judgment and an appeal bond is approved by the court, the bond prevents the removal of the defendant and the execution for damages and costs. Section 35 10 5(B).
  3. Appeal bonds are approved by the judge and are in the same form as in other civil cases.
