A. Discovery

1. For good cause shown, either party may request discovery of documents of the other at any time during the pendency of the action. Magis. Ct. R. 2-501; Metro. Ct. R. 3-501.
2. Upon written or oral motion the judge may order either party to produce for inspection and copying any records, documents, papers or other tangible evidence. Civil Form 4-501 (Motion for Production).
3. If both parties are represented by counsel, the judge, for good cause shown, may order further discovery, according to the Rules of Civil Procedure for District Courts. Magis. Ct. R. 2-501(G); Metro. Ct. R. 3-501(G).
4. A party requesting discovery must specify the evidence to be produced. Civil Form 4-502 (Order for Production).
5. For good cause shown, the judge may order a party to produce for inspection and copying any records, documents, or other tangible evidence in that party’s possession or otherwise available to that party. Magis. Ct. R. 2-501(F); Metro. Ct. R. 3-501(F).

B. Pretrial Conference (Magis. Ct. R. 2-306; Metro. Ct. R. 3-306)
The purpose of a pretrial conference is to enable the judge to clarify the pleadings or consider such other matters as may aid in the disposition of the case.

C. Notice of Trial (Civil Form 4-401 (Notice of Trial))
After the answer has been filed, the judge will set a date for trial of the action. The court shall issue a written notice of trial announcing the time and place. This notice shall be sent to each party.

D. Recording of Trial (See also §3.5-2 of this Benchbook.)

1. The Metropolitan Court is a court of record with respect to civil actions. Metro. Ct. Rules 3-706, 3-707, and 3-710; see also Metro. Ct. R. 3-109 (defining “record”). Every civil proceeding must be tape recorded if requested by a party. Metro. Ct. R. 3-708.
2. If a party wants a record of a Metropolitan Court hearing, a written request must be made not less than ten (10) days prior to the hearing. Metro. Ct. Rules 3-109(B) and 3-110.
3. Magistrate Court is not a court of record. A party may, however, at the party's expense, have a stenographic or other recording made of a civil trial. Magis. Ct. R. 2-601(B) and 2-109(A). The requesting party may use the court’s tape recorder, but must supply the tape. Any record made must be filed with the case file and becomes a part of the official record of the proceedings.
4. In Magistrate Court, taking photographs, recording or transmitting of judicial proceedings for broadcasting by radio or television is not permitted except upon express approval of the Supreme Court. Magis. Ct. R. 2-102 and 6-102. Non judicial proceedings carried out as ceremonies may be photographed or broadcast with permission and supervision by the Magistrate Court.
5. In Metropolitan Court there are no restrictions on photographs and broadcasting from the courtroom.

E. Appointment of Special Master, Arbitrator or Metropolitan Court Judge Pro Tempore (Section 34-8A-4.2(A))

1. The chief Metropolitan Court judge may appoint a retired Metropolitan Court judge, with the retired judge’s consent, to serve as a special master, an arbitrator or a Metropolitan Judge pro tempore, subject to the availability of funds in the Metropolitan Court operating budget.
2. The appointed judge should be compensated for his or her services in an amount equal to 90% of the compensation provided to a district court judge pro tempore.
