A. Documents:

  1. The Domestic Violence, Immigration and Child Custody Court Guide (adapted from the Supreme Court of Ohio’s Domestic Violence and Allocation of Parental Rights and Responsibilities Court Guide) is a tool to consider domestic violence-related information presented in these cases and assess the impact of this information in light of possible future risks, statutory best interest factors, potential immigration considerations, and appropriate parenting time arrangements.  The Guide is meant to bring to the forefront the intersection of this information to help courts craft orders that maximizes safety and well-being of the children and their parents.
  2. The Immigration and Domestic Violence Risk Factor Guide for Civil Judges is a tool to assist Civil Court judges in identifying domestic violence risk factors and to offer legal remedies or specific conditions that may be appropriate that respond to the correlating risk. This Guide also includes special considerations that are present for immigrants, particularly individuals who are undocumented, have temporary status, or are part of mixed-status families or communities. This Guide may also be valuable in assisting courts in crafting parenting plans, parental access and visitation orders in cases involving domestic violence. The Guide is not exhaustive, is not meant to be a substitute for the court’s discretion in determining the credibility of the allegations and weight of each factor and is not meant to be filled out, scored in any way, or placed in any court file.
  3. Access to State Funded Public Benefits in New Mexico Based on Immigration Status (August 28, 2017)
