Tutorial on the crimes of stalking and harassment for New Mexico judges

This module discusses commonly seen evidentiary issues in stalking and harassment cases. The issues may arise either in the pre-trial context or during trial. Evidentiary issues might be brought to the court's attention by written motions, oral motions, or objections made to the proposed introduction of evidence. As with other criminal cases, in stalking and harassment cases two main categories of evidence are generally sought to be introduced:

  • Testimonial evidence from witnesses; and
  • Physical or documentary evidence.

Each category is discussed separately.
