Leaving a Copy of the Petition in Clerk's Office

A judge needs to determine if it is allowable to leave a copy of a petition for a candidate in the clerk's office.

Can the judge leave a copy?

Yes
Not allowable. Putting a copy of the nominating petition violates the conditions of the Advisory Opinion 96-01 of the Advisory Committee of the Code of Judicial Conduct, issued January 26, 1996, which warns against use of court facilities to circulate petitions. It also violates NMRA 21-700 (B)(2), which requires a candidate to prohibit staff from doing what the judge may not do under the rules.
