Much of the evidence presented in American courtrooms today is never printed or available in a paper format. Rather, evidence is electronically stored on computers, tablets, cell phones and other electronic devices. In 2006, the Federal Rules of Civil Procedure were amended to include electronically stored information (ESI) as a separate category of discoverable materials and to address some of the challenges related to electronic discovery. Many states have changed, or are in the process of changing, their rules of civil procedure to accommodate electronic discovery (e-discovery). A growing segment of ESI concerns social media and with the significant increase in social networking, and its potential for use in litigation, judges are being asked to address whether a litigant is entitled to social media evidence, how it may be discovered, and whether it is admissible.

The National Judicial College is pleased to present Social Media and E-Discovery: A Basic Overview of the Impact of Social Media on E-Discovery. This webcast will enable judges to: (1) identify and become familiar with rules regarding electronically stored evidence (ESI) as they relate to social media; (2) Rule on issues involving the identification, preservation, search, review, production, and admission of social media ESI; and (3) define ESI terminology such as metadata and other electronic discovery terms which relates to adjudicating e-discovery disputes involving social media.

The 75-minute webcast is scheduled for November 20, 2014, at Noon Pacific / 1:00 Mountain / 2:00 Central / 3:00 Eastern. The webcast faculty includes Justice Daniel J. Crothers (North Dakota Supreme Court) and Judge Thomas A. Zonay (Superior Court, Vermont).
